@taniwharugby I wonder if the prosecution fucked up by going for murder. He certainly contributed to her death and he's a sleazy shitbag but murder might be a stretch. Anyone got a legal definition?

Very broadly manslaughter would be his actions were responsible for her death and murder would be that the he had the intent to cause her death.
There seems to me to be some confusion or uncertainty over what her physical actions were that triggered the final part of the incident, and led him to allegedly choke her and then lock her out on the balcony. She seems to have been throwing ornamental "rocks" at him (they looked more like stones, or even gravel sized, but not as small as pebbles). She also seems to have been attacking him with muay thai (that is thai kickboxing right?). There also seems some suggestion that she attacked him with some sort of object.
An alleged transcript of the recording published in the Goldie Bulletin (not sure how reputable this is) to me implies that he accuses her of trying to kill him, had hit him with something, and him ordering her to let it go [i.e. an object] while a struggle ensues.
The recording is tantalising evidence but still leaves you in the dark as to what happened.

I reckon the jury in the Gable Tostee trial is leaning toward acquitting him. They've leaned heavily on the judge for instructions the last couple of days. I think its quite telling that the judge gave two affirmations which seem to work in GT's favour. First, the judge affirmed that GT removing WW from his apartment onto his balcony (from which she almost immediately jumped) constitutes him removing her from his home. Second, the judge affirmed that words are not physical force when it comes to the question "did he use excessive force in removing her from his home" (at one point he allegedly said something like "I should chuck you off the balcony you goddamn psycho bitch").
To me it looks like the jury is leaning toward acquitting him and they are working through the concerns of the holdouts, so that they can get a unanimous verdict.
Fucking gripping stuff huh? Tostee is a douche, no doubt, but WW was nuttier than squirrel turd. Murder would be a travesty. Manslaughter still on the table.

haha yeah he is a giant turd, but I don't think he murdered her, doesn't the very definition of murder require pre-meditation and I would expect direct involvement, ie actually pushing her??Surely manslaughter woulda been much easier to prove, but I guess they had their reasons for going for murder?
