It's an old gun that needs to be cocked. One theory is that he cocked it without realising that he was holding the trigger down, so it would have fired (he was drawing the gun, so easy to do).

So he may be technically correct, but it's impossible to know for sure.

The real issue is that there was a real bullet in the gun.
