Yes since before 2011 RWC for sure

I don't like that reasoning, the answer is not make a dangerous tackle. However if a guy nearly falling over is considered upright then there's something wrong.

The Force kicker looks a bit 'special' when he kicks for goal.

Watch it at normal speed...
Certainly no malice.. Not deliberately head hunting..
Im guessing it's being implied that he was beaten, therefore shouldn't attempt the tackle.. As he wasn't going to be able to get low enough.
