    @crucial IIRC, it's just the groove that's the same, and not the melody. That opens a real can of worms ... There's a lot of people who took the beat and bassline from You Can't Hurry Love by The Supremes. e.g. The Jam.

    @tim I get that. Play them side by side and they are different songs. I think the issue is that MGs song had a quite unique groove that was 'copied' without credit. Certainly don't understand how you could rule in favour of the estate based on the judge's criteria (and that the judge's criteria is straight out bullshit).
    GTGIU was certainly the inspiration and influence behind the song though and I guess when you do that you run a risk that someone is going to ask for their share. Obviously it is the amount of money that BL earned that prompted the lawsuit. I don't like the implications but also think that if you are going to copy parts of someone's work it doesn't hurt to check with them first. In this case it is hard to see how you would feel you need to do that though.
    Really interesting argument over whether someone 'owns' a bassline or riff though. You mentioned the Jam and their use in numerous songs of The Beatle's 'Taxman' bassline (as a baseline and a riff) is well known. It was taken as flattery rather than a monetary ripoff though.
    Millions of songs use the same drum beats.

    @crucial Well, hopefully there'll be a successful appeal. Would hate to think that re-using song and genre style elements was shut down. There'd be a lot less Led Zep songs etc if that was the case back then.

    ps. A Town Called Malice was the Supremes comparison I was going for.

    Yeah, realised that. Bruce added one extra note into James Jamerson's brilliant line.

    Wouldn't like to think of Berry Gordy collecting of something he paid a couple of bucks an hour for though.

    Stairway to Heaven for starters. They even toured with these guys before Stairway was released, and the opening sequence sounds so similar it's freaky. Someone is copying someone, I don't know how much needs to be similar to be considered plagiarism

    I reckon both bands got the intro simply by walking into their local guitar shop. There is always some ponytailed geek sitting in the corner playing it.

    The judge in the Chiifons-Harrison case set a precedent with his "unconscious plagiarism" decision that anyone who wants a retirement bonus can try and leverage.

    sampling has massively declined since the De La Soul v Turtles case

    This is a crock of shit. The two songs are totally different, clearly the two judges that sided with the Gaye estate were deaf or just didn't listen to the music.

    On a side note, it seriously fucks me off when I see sentence discounts given for 'remorse'. Anyone can turn on the tears after the fact, and if they know it's probably going to reduce the sentence...ARGH. Bullshit.
