    @jegga anytime you drive a vehicle while under the influence and crash, it should never be considered an 'accident'

    If someone was out hunting while under the influence and accidentally shot another person, would that still be deemed an accident and therefore be granted home d?

    Yeah much different story if she had stopped and called emergency services. For all she knew had the emergency services attended earlier they might have been able to save him.

    The lawyers and the judge are all working within the framework of the law. I don't doubt the judge could have put a harsher sentence on her... but still not that harsh. Little actually made an OK comment that the law hasn't been reviewed in a long time so maybe it should be. I agree, I'd like to see way fucking tougher sentences for reckless driving like this.

    @no-quarter yeah nah...in my old job I used to see Judges summing of cases in relation to charges following a Motor Accident (some fatal) and it would seem many motor 'incidents' seem to be looked at in a different light than similar result from non-motor incidents...as per the Lawyer statement 'it was an accident' regardless of being under the influence, where it should not be an accident (although that might where you are correct in that as it involved a vehicle, it is deemed a motor 'accident')

    Worst one I saw (as mentioned earlier) was from a fatality, a dude and his mate had been racing and overtaking have hit and killed a guy on his way home from a Tangi...Judge said he felt Home Detention was harder for him than prison time due to being a prisoner in your own home (with fridge of food, alcohol, TV, Sky, PS$/Xbow, mates visit etc)

    so this article says she was 'drunken'.. but the next one says she wasn't, had just had something to drink earlier in the way.. something that thousands of people do every day - and is legal...
    which was it? pretty important point.. cause one is 'ok to drive' one is 'should not have been in a car'.

    Also, although she's obviously a piece of sh*t.. i also look to the 'first infringement'.. which was the kid went through a red light. I think people are missing that.

    as a cyclist i'm pretty adamant you go thru a red and get hit it's your fault - and it's a pretty shtty situation to put a driver in who now has to deal with your sht decision.

    As the mum of the kid said, she had a lot of sympathy for the girl. It was all those instagram posts that turned the tide of opinion against her. Tasteless, remorseless, millenially stupid
